New Delhi: The Department of Consumer Affairs is set to unveil three innovative applications—the Jago Grahak Jago App, Jagriti App, and Jagriti Dashboard—on the occasion of National Consumers Day on December 24, 2024. These apps aim to empower consumers and combat deceptive practices, particularly ‘dark patterns’, in the e-commerce space.
Understanding Dark Patterns
Dark patterns are deceptive design techniques used by websites and apps to manipulate users into making unintended choices, such as subscribing to services, sharing data, or making purchases they didn’t intend. These practices have become a significant concern for consumer rights advocates as they exploit user behavior and undermine informed decision-making.
In 2023, the Central Consumer Protection Authority (CCPA) issued Guidelines for the Prevention and Regulation of Dark Patterns, identifying 13 specific tactics, such as Basket Sneaking, False Urgency, Confirm Shaming, and Drip Pricing. These practices often mislead consumers into unintended actions like hidden charges, unnecessary subscriptions, or forced purchases.
Addressing Dark Patterns in E-Commerce
The CCPA has actively taken action against platforms such as IndiGo Airlines and BookMyShow for using dark patterns. BookMyShow faced scrutiny for auto-adding a Re 1 donation to “BookASmile” without consumer consent, categorized as Basket Sneaking. Following the intervention, the platform revised its practices by offering users a clear choice. Similarly, IndiGo Airlines was flagged for Confirm Shaming and lack of transparency in seat selection. The airline has since modified its app and website to ensure clear and neutral communication.
The Role of the Newly Introduced Apps
The government’s upcoming apps are designed to combat these unethical practices. Each app has been designed to address specific areas:
Jago Grahak Jago App: It will provide real-time alerts about potentially unsafe or manipulative URLs during online activities.
Jagriti App: This app will allow users to report suspected dark patterns on e-commerce platforms, directly registering complaints with the CCPA.
Jagriti Dashboard: Complementing these two apps, this app will generate real-time reports on e-commerce practices, aiding the CCPA in monitoring and regulation.
