New Delhi: The Centre has amended the Central Motor Vehicles Rules, 1989, to tighten enforcement of user fee payments at toll plazas on National Highways and curb toll evasion. The changes were notified through the Central Motor Vehicles (Second Amendment) Rules, 2026.
Under the amended rules, an “unpaid user fee” has been defined as toll charges that remain unpaid despite a vehicle’s passage being recorded by the Electronic Toll Collection (ETC) system. To ensure compliance, clearance of pending toll dues has been linked to key vehicle-related services.
Transport authorities will now deny No Objection Certificates (NOCs) for the transfer of ownership or inter-state movement if toll dues are outstanding. Issuance or renewal of a Certificate of Fitness and grant of a National Permit for commercial vehicles will also be subject to clearance of unpaid user fees.
Form 28 has been updated, requiring applicants to disclose any outstanding toll demands. The amendments also allow electronic issuance of Form 28 through an online portal.
The government said the changes will support barrier-less tolling under the upcoming Multi-Lane Free Flow system and strengthen technology-driven toll collection.
